Blyxon - Terms and Conditions
 
Important - Please Read Carefully:
These Terms and Conditions ("Terms") establish a legal agreement between you and Blyxon Ltd.  ("Blyxon"). They govern your use of Blyxon' services ("Services"), which include websites, games, apps, and related services.

By using the Services, you acknowledge that you have read, understood, and agree to these Terms and any related Privacy Policy.
 
1. License and Usage Restrictions:
  • Blyxon grants you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes, unless explicitly stated otherwise.
  • You must not modify, reverse-engineer, or engage in any unlawful activity related to the Services.
  • The license for apps is for personal use and may not be copied, resold, or sub-licensed.

2. Third-party Products, Services, and Links:
  • Blyxon may offer third-party products through the Services. Your use of these products is subject to their own terms and policies.
  • The Services may contain links to third-party websites, over which Blyxon has no control. Blyxon is not responsible for the content or availability of these external sites.

3. Access to the Services:
  • Users affirm their age when accessing the Services.
  • Minors must have parental consent to use the Services.
  • Users are responsible for maintaining the confidentiality of their accounts.

4. In-App Purchases:
  • Virtual Currency and Virtual Items may be obtained through the Services for in-game use.
  • These items have no real-world value and cannot be resold.
  • Payments for Subscriptions, Virtual Currency, and Virtual Items are handled by app stores (Google Play or Apple App Store). 
  • Subscriptions are available in some games and automatically renew unless canceled.
  • You are solely responsible for managing, renewing, or canceling your subscriptions or purchases. If you require a refund, please contact the respective app store (Google Play or Apple App Store) directly, without involving Blyxon in the process.
  • Golden items that have been purchased during active subscription will remain in your possession, but their access will be restricted (locked) upon cancellation or expiry of the subscription.
  • You can restore access to your owned golden items (unlock them) by resuming a golden or a higher-tier subscription at any point in the future.

5. Online Content and Conduct:
  • Socializing means -as chat- within the Services allow users to interact with each other.
  • Users are responsible for their content and must follow guidelines for non-commercial use.
  • Blyxon may monitor and remove inappropriate content or accounts without any prior warning.
  • Third-party Social Platforms have their own terms of use.
  • Users must not engage in illegal or harmful activities within the Services.

6. Ownership and Intellectual Property:
  • All rights to the Services and content therein are retained by Blyxon.
  • Users may not use, copy, or modify the Services or content without written permission.

7. Disclaimer of Warranty and Limitation of Liability:
  • The Services are provided "as is," and Blyxon makes no warranties about their suitability or uninterrupted operation.
  • Blyxon is not liable for any damages arising from your use of the Services.

8. Indemnification:
  • Users agree to indemnify and defend Blyxon against any losses or claims related to their use of the Services or content.

9. Termination:
  • These Terms will terminate automatically without notice if you breach any of the rules set out in these Terms.
  • You or Blyxon may terminate or cancel your account at any time.
  • Certain provisions of these Terms will survive termination.

10. No Assignment:
  • These Terms and licenses are personal and may not be assigned without written consent.

11. Notification:
  • Claims related to the Services should be addressed to Blyxon' legal counsel.

12. Feedback:
  • Blyxon does not accept unsolicited feedback but reserves the right to use provided feedback for improvement.

13. General:
  • These Terms, along with the Privacy Policy, constitute the full agreement between you and Blyxon.
  • Blyxon may update the Terms, with changes becoming effective immediately upon notice.
